Regulation 2024/2462: what’s new?
Last February 2024, the European Commission published a draft proposal of what is restriction 79, offering a preview of the changes to Annex XVII of Regulation 1907/2006 (REACH).
On 20 September 2024, the European Commission adopted Regulation (EU) 2024/2462, amending Annex XVII of Regulation 1907/2006 (REACH) of the European Parliament and of the Council, restricting the use of undecafluorohexanoic acid (PFHxA), its salts and related substances. The updated text does not contain a clear-cut list of substances affected by this restriction, but defines a list of exemptions for specific substances depending on their molecular structure.
Restriction 79 prohibits the placing on the market and use of products in a concentration equal to or greater than 25 ppb for the sum of PFHxA and its salts, or 1 000 ppb for the sum of PFHxA related substance.
Regulation 2024/2462: when?
Although Regulation 2024/2462 entered into force on 10 October 2024, the ban on placing on the market will apply for certain product types and from certain dates if the total concentration of PFHxA (as acid, salt or related substance) exceeds the relevant limit for the type of substance:
- In various products intended for the general public, including textiles, footwear, food contact materials and cosmetic products, the ban applies from 10 October 2026.
- In textiles, furs and leather products not used in clothing, the ban applies from 10 October 2027.
- To fire-fighting foams, with exceptions for specific tests, the ban applies after 10 April 2026.
- To fire-fighting foams used in civil aviation, the ban applies after 10 October 2029.
