EDA considerations on Rules of Origin to be Applied in the EU-UK Dairy Framework
On May 11, 2020, the European Dairy Association (EDA) has published a consensus paper on the 'rules of origin' to consider in view of Brexit.
Rules of origin are applied among WTO members to define where the product was made to ensure transparency, avoid disruptive effect on international trade, and other fundamentals.
Brexit will imply the UK to become a third country, therefore rules of origin would follow the WTO agreement or a free trade agreement (FTA) between the United Kingdom and the European Union.
The EDA expressed concerns on creating special rules for each FTA and supports the rules for internal EU-UK trade to be subject to cumulation. Moreover, the rules of origin should apply both by the EU and the UK towards third countries.
Finally, the document includes percentages of limit of non-originating material from third countries in relation to granting a product originating status, following the Harmonized System (HS).
