Regulation 2024/1328: what’s new?
Regulation 2024/1328 updates Annex XVII of REACH by extending the scope of restriction 70 related to cyclosiloxane compounds D4, D5, D6.
Restriction 70, which already limited the use of the cyclosiloxane compounds D4 (Octamethylcyclotetrasiloxane, CAS 556-67-2, EC 209-136-7) and D5 (Decamethylcyclopentasiloxane CAS 541-02-6, EC 208-764-9) in rinse-off cosmetic products, has been strengthened and extended. Now, the restriction 70 also applies to D6 (Dodecamethylcyclohexasiloxane, CAS 540-97-6, EC 208-762-8).
In particular, the placing on the market ban involves D4, D5 and D6 when present as substances, as constituents of other substances, or in mixtures, if their concentration is equal to or greater than 0.1% in any type of chemical product.
Regulation 2024/1328: when?
The regulation came into force on June 6th 2024, but the placing on the market ban will start on June 6th 2026. However, there are specific transition periods for certain products:
- For all cosmetic products other than wash-off cosmetics containing D4 and D5, the regulation applies after June 6th
- For substances D4, D5 and D6 used in medical devices, medicinal products for human use and veterinary medicinal products, the regulation applies after June 6th 2031
- For substance D5 used as a solvent for the dry cleaning of textiles, leather and fur, the regulation shall apply after June 6th 2034
