The 23rd ATP draft

Last September 25th 2024, the European Commision published a draft proposal of what will become the 23rd ATP (Adaptation to Technical Progess), offering a preview what amendments to Reg. 1272/2008 will be issued in the future.

The 23rd ATP draft: what’s new?

The purpose of the draft text of what will become the 23rd ATP is to amend Table 3 of Part 3 of Annex VI to the CLP Regulation, by introducing 24 new harmonised classifications and modifying 10 preexisting entries.

Among the substances covered by the 23rd ATP, there are:

• Ozone (CAS: 10028-15-6) (proposed harmonised classification: Ox. Gas 1, H270; Carc. 2, H351; Muta. 2, H341; Acute Tox. 1, H330; STOT SE 1, H370; STOT RE 1, H372; Aquatic Acute 1, H440 with M = 100; Aquatic Chronic 1, H410, with various specific concentration limits)
• Dinitrogen Oxide (CAS: 10024-97-2) (proposed harmonised classification: Repr. 1B, H360Df; STOT SE 3, H336; STOT RE 1, H372; Ozone 1, H420)
• Tetrahydrofurfuryl Methacrylate (CAS: 2455-24-5) (proposed harmonised classification: 1B, H360Df; Skin Sens. 1A, H317)
• Trimethylcyclohexyl Isocyanate (CAS: 4098-71-9) (The proposal provides for the worsening of the existing harmonized classification as follows: Acute Tox. 1, H330; Skin Corr. 1, H314; Eye Dam. 1, H318; Resp. Sens. 1, H334; Skin Sens. 1, H317; Aquatic Chronic 2, H411, with the addition of a ATE for inhalation of dust/mist of 0.03 mg/L and a modification to the specific concentration limit for Skin Sens. 1A).

The 23rd ATP draft: when?

The expected adoption period of the 23° ATP is in fourth quarter of 2024.
