On 14 March 2024, the Official Journal of the European Union published Commission Regulation 2024/858 on the use of certain nanomaterials, amending the Regulation 1223/2009. Following opinions issued by the Scientific Committee on Consumer Safety (SCCS) regarding the safety for use in cosmetic products, it has been identified that the utilization of specific nanomaterials may present a potential hazard to human health.
The following 12 nanomaterials have been added to Annex II of Regulation 1223/2009, amending the list of substances prohibited in cosmetic products:
In addition, use restrictions have been introduced for the nanoform of Hydroxyapatite.
Regulation 2024/858 will apply starting from April 4th 2024. However, the following transitional periods are defined:
