Europe: The Regulation 1223/2009 on cosmetic products has been updated

EU Cosmetic regulation amended

On 14 March 2024, the Official Journal of the European Union published Commission Regulation 2024/858 on the use of certain nanomaterials, amending the Regulation 1223/2009. Following opinions issued by the Scientific Committee on Consumer Safety (SCCS) regarding the safety for use in cosmetic products, it has been identified that the utilization of specific nanomaterials may present a potential hazard to human health.

Regulation 2024/858: what’s new?

The following 12 nanomaterials have been added to Annex II of Regulation 1223/2009, amending the list of substances prohibited in cosmetic products:

• Styrene/Acrylates copolymer (nano)
• Sodium Styrene/Acrylates copolymer (nano)
• Copper (nano)
• Colloidal Copper (nano)
• Colloidal Silver (nano)
• Gold (nano)
• Colloidal Gold (nano)
• Gold Thioethylamino Hyaluronic Acid (nano)
• Acetyl heptapeptide-9 Colloidal gold (nano)
• Platinum (nano)
• Colloidal Platinum (nano)
• Acetyl tetrapeptide-17 Colloidal Platinum (nano).

In addition, use restrictions have been introduced for the nanoform of Hydroxyapatite.

Regulation 2024/858: When?

Regulation 2024/858 will apply starting from April 4^th 2024. However, the following transitional periods are defined:

• February 1^st 2025 for new cosmetics products
• November 1^st 2025 for cosmetics product already placed on the market.
