Last June 26th the European Commission published Regulation 2020/878 which will replace the previous regulatory reference for the compilation of Safety Data Sheets (Regulation 2015/830).
Among the major changes to the SDS requirements, we report:
The date of application is January 1st 2021. However, according to Article 2 of the Regulation, SDS complying with Regulation 2015/830 may continue to be provided until December 31st 2022.
This transitional period also applies to SDS created after the application date: thereby, until December 31st 2022, it is possible to choose whether to continue using the Safety Data Sheet in accordance with Regulation 2015/830 or to use the updated format right away, as communicated in the national REACH Helpdesk’s reply (reported below):
“The transitional period also applies to new SDSs issued after the entry into force of Regulation 2020/878: these can be compiled according to the old format until December 31st 2022 or immediately according the new format.”
After the transitional period, all Safety Data Sheets must be produced in accordance with the new Regulation.
